These Terms & Conditions (“Terms”) apply when you buy products from our website. By placing an order, you agree to be bound by these Terms. Our Privacy Policy and Tool Safety Guidelines also apply and are available on our website.

Products and pricing

- We make every effort to display products accurately, but colours and images are for illustration only and may vary slightly.

- All prices are in British Pounds (£). No VAT is charged.

- We reserve the right to change prices at any time, but price changes will not affect orders we have already accepted.

- If a product is incorrectly priced, we will contact you and give you the option to reconfirm or cancel your order.

Placing an order – when is the contract formed?

Your order is not legally binding immediately. Here is how it works:

1. You click “Place Order” – this is an offer to buy.

2. We send you an order acknowledgement email – this confirms we have received your offer but does not accept it.

3. A legally binding contract is formed only when we send you a dispatch confirmation email. We may cancel any order before dispatch if the product is out of stock, a pricing error occurred, or we suspect fraud.

Payment

- Payment is taken at the time you place your order.

- We accept major credit and debit cards and any other payment methods stated at checkout.

- By providing payment details, you confirm you are authorised to use that payment method.

- We use third-party payment processors. We do not store your full card details.

Delivery

- Delivery is free of charge within the UK (England, Scotland, Wales, Northern Ireland). We do not deliver to the Channel Islands or international addresses.

- Estimated delivery times are shown at checkout. These are estimates only and not guaranteed.

- Risk of loss or damage to products passes to you when the products are delivered to your address.

- If a delivery is delayed due to events outside our reasonable control (e.g. weather, courier strikes), we will not be liable for the delay, but we will keep you informed.

Your right to cancel (14-day cooling-off period)

Under the Consumer Contracts Regulations 2013, you have the right to cancel this contract within 14 days without giving any reason.

- The cancellation period expires 14 days after the day you receive the goods (or the last item if delivered separately).

- To cancel, you must inform us clearly by email at sales@gamma-trading.co.uk before the 14-day period ends. Include your order number.

- You must then return the goods to us within a further 14 days of telling us you wish to cancel.

Who pays for return postage?

- For cancellations (change of mind): You pay the return postage cost.

- For faulty or incorrect items: We pay

– we will email you a prepaid returns label or reimburse reasonable postage costs.

 

We recommend using a tracked delivery service and keeping proof of postage. We are not liable for items lost or damaged in return transit.

 

Returns, refunds, and the diminished value rule for used tools

If you cancel within the 14-day cooling-off period, we will refund you within 14 days of receiving the returned goods (or proof of return)

 

Condition of returned goods – important for tools:

You are only liable for any diminished value of the goods if you have handled them beyond what is necessary to establish their nature, characteristics, and functioning. In practice:

- You may open the packaging and inspect the tool as you would in a shop.

- You may not use the tool for a job and then return it.

 

If a tool is returned showing signs of use beyond simply opening the packaging (e.g. scratches, dirt, worn parts, sawdust, or other evidence of use), we reserve the right to:

- Reduce the refund amount to reflect the diminished value, or

- Deny the return altogether and send the tool back to you (you will be responsible for delivery costs).

 

We will notify you before making any deduction.

 

Non-returnable items (exceptions to the 14-day right to cancel):

The right to cancel does not apply to: - Sealed goods that were unsealed after delivery for health protection or hygiene reasons (e.g. certain safety equipment). - Customised or personalised tools (e.g. with engraving or special modifications).

 

Faulty or damaged goods (Consumer Rights Act 2015)

Under UK consumer law, goods must be of satisfactory quality, fit for purpose, and as described.

- Within 30 days of receiving faulty goods, you can reject them and get a full refund.

- Within 6 months, we will offer a repair or replacement. If repair/replacement is unsuccessful or significantly inconvenient, you can claim a refund (we may deduct reasonable use).

- After 6 months, you may still have rights if the fault was present at delivery – but you may need to prove it.

 

If you receive a faulty or incorrect item, please contact us immediately at sales@gamma-trading.co.uk with:

- Your order number - A clear description of the issue

- Photographs showing the fault or mismatch

We will cover return postage for faulty items.

 

Our liability to you

Nothing in these Terms excludes or limits our liability for:

- Death or personal injury caused by our negligence

- Fraud or fraudulent misrepresentation

- Defective products under the Consumer Rights Act 2015

- Any other liability that cannot be excluded by UK law

 

To the maximum extent permitted by law:

- Our total liability to you for any claim arising from your purchase is limited to the price you paid for the product.

- We are not liable for indirect or consequential losses (e.g. loss of profits, loss of business, damage to other property caused by misuse of a tool).

- We are not liable for injuries resulting from misuse, unauthorised modification, or failure to follow safety instructions and manufacturer guidelines.

Governing law and jurisdiction

hese Terms are governed by the law of England and Wales. Any dispute arising from these Terms or your purchase shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Changes to these Terms

We may update these Terms from time to time. Any changes will be posted on this page with an updated "Last updated" date. Changes will not apply to orders we have already accepted.

Entire agreement

These Terms, together with our Privacy Policy and Tool Safety Guidelines, form the entire agreement between you and Gamma Trading regarding your purchase.
